APPEAL TO STOP THE ACTIVITY OF MINING & SLAUGHTERING IN BIMA,Friend of the Earth Asia Pacific is the regional group of the Friends of the Earth International, the largest Grassroots’ environmental network spread in 77 countries.
We were shocked to learn the attack by the Australian mining company ArcExploration (PT. Sumber Mineral Nusantara), Indonesian National Police and Military on December 24, 2011, against the members of Anti-Mining People’s Front (FRAT) during a peaceful protest at the Sape Harbor which started four days ago. As we are aware those civilians rejected the presence of a gold mine, PT. Sumber Mineral Nusantara (SMN) with majority shares by the Australian mining corporation.
We have learned that government of Indonesia deployed troops of Brimob (Mobile Brigade) and riot equipments which shot at the protesters this morning which killed 3 people and cause critically injuries in 8 others. FRAT rejected this mining operation because it would endanger the livelihood of civilians, farmers and the fisher folk. They believe that the mine will destroy their land and disrupt water resources which will affect residents’ agricultural lands.
We have learnt that about 1500 people came to Lambu’s sub district office in January 2011 to convey the refusal. Unfortunately, they did not get any satisfactory response. On February 2011, thousands of residents carried out a march to Lambu’s sub district office. Since then people had several events to show the opposition, which did not make any satisfactory results.
Residents reported to the National Human Rights Commission, which lead to conduct an investigation on April 2011. On November 2011, The National Human Rights Commission issued a recommendation No. 2.784/K/PMT/XI/2011 for The Regent of Bima, The West Nusa Tenggara Chief of Police, and The Director of PT. SMN. The National Human Rights Commission recommended The Regent of Bima to improve the information system and publicize mining activities; started from exploration to exploitation, and also to suspend the activities of PT. SMN while waiting for the conduciveness of society’s social life. The West Nusa Tenggara Chief of Police was asked to take coordinative and communicative steps with all elements of government and community leaders to prevent horizontal conflicts in Bima.
The National Human Rights Commission urged the warranty for residents’ freedom of speech or aspiration (demonstration) in accordance with statutory provisions, and to avoid repressive measures by using weapons with live ammunition in securing rallies.
However, the Peaceful actions conducted since December 21, 2011 was terminated with violence and massacre. There were 3 people died and 8 people wounded.
We are sure you will agree foreign owned companies, such as ArcExploration, should be held accountable for acts of violence against Indonesian nationals.
We are concern that throughout the year of 2011, the violence conducted by the government agencies and the police force against the peasants has increased. Walhi, the Indonesian member of the Friends of the Earth International, recorded 103 cases of conflicts over natural resources sectors in Indonesia.
The Indonesian government has obligations towards the respect and protection of people's human rights to life, to expression, and their right not to be deprived of their own means of subsistence. Furthermore, the government is under obligation to protect human rights defenders against any attacks, especially by state forces. The attack last December 24 is a clear violation of human rights and the documented cases of violence against farmers over natural resources show a troubling pattern of widespread human rights violations against the Indonesian people.
We demand justice for the victims of the recent attack by Indonesian security forces against members of the Anti Mining Peoples Front (FRAT) who were on a peaceful demonstration against the gold mine of PT. Sumber Mineral Nusantara (SMN) in defense of land and water resources needed for the livelihood of farmers and fisherfolk.
Therefore we appeal for your urgent intervention in this matter and direct the authorities to stop all brutal attack against the unarmed civilians. We also appeal your Excellency,
a)to revoke the Mining Permit of PT. Sumber Mineral Nusantara (SMN),
b)investigate the role of the foreign owned company in the killing of Indonesia nationals,
c)to withdraw and evaluate all forces of Indonesian National Police and Military at the location of natural resource conflicts.
d)to immediately stop the mentioned company’s activities which created and potentially create conflicts until the certainty of settlement is structurally created by establishing the National Committee for Resolution of Agrarian Conflicts and Natural Resources and
e)to ensure legal protection for the victims.
